1.2 The terms and conditions contained in this agreement set out your obligations and our obligations when using Luxo Styles ordering service and delivery service ("the Services") through the website www.luxostyles.com.au ("the Site") or our telephone ordering service.

1.3 When you register an account with us to use the Services, you are deemed to have accepted this agreement, as amended and varied by us from time to time.

1.4 We may amend this agreement from time to time and you should review this agreement from time to time. If you continue to use the Services following any amendment to this agreement, this constitutes your acceptance of the new terms and conditions applying to the Services.

1.5 If there are any additional conditions about the Services, contained in other website pages on the Site, these will be incorporated into and will form part of this agreement, unless those additional conditions conflict with these terms and conditions. You must read all information available on the product information page of any item or product you intend to order before placing an order through the Services. 

2.BINDING TERMS AND CONDITIONS2.1 Purchase Order, Purchase Order Acknowledgement and Terms and Conditions

• A Purchase Order or an offer to purchase can be made by the Customer form to tome, however, the Purchase Order shall be deemed accepted when the Customer receives an acknowledgement of the Order from LUXO STYLES or delivery of the relevant Goods, whichever first occurs ("Purchase Order Acknowledgement").
• The Terms and Conditions apply to every Purchase Order unless otherwise agreed in writing by LUXO STYLES.
• The Customer acknowledges that the Terms and Conditions constitute a security agreement and that LUXO STYLES may register a financing statement in respect of the security interests provided for under these Terms and Conditions.
• By submitting a Purchase Order to the Company, the Customer hereby agrees and acknowledges that it accepts and ratifies the Terms and Condition Apply and are being bound on the Customer.

2.2 Contract

• The Contract shall comprise of the following documents, in order of precedence:
  • Purchase Order and Purchase Order Acknowledgements;
  • These Terms and Conditions;
  • Any other document which is attached to, or incorporated by reference in, the Purchase Order or these Terms and Conditions.
• The Contract constitutes the entire agreement between LUXO STYLES and the Customer concerning the Purchase Order. All prior negotiations, proposals, previous dealings, correspondence, trade custom and/or trade usage are superseded by and will not affect the interpretation of the Contract.
• If at any time about a Purchase Order, the Customer Provides, refers to, submits or otherwise uses terms and conditions other than the Terms and Conditions, such terms and conditions will not form part of or be incorporated into the Contract.

Accuracy of content 

We have taken proper care and precautions to ensure that the information we provide on this Website is accurate.  However, we cannot guarantee, nor do we accept any legal liability arising from or connected to, the accuracy, reliability, currency or completeness of anything contained on this Website or any linked site.The information contained on this Website should not take the place of professional advice.

These terms and conditions are governed by and construed under the laws of NSW, Australia.  Any disputes concerning this website are to be resolved by the courts having jurisdiction in NSW We retain the right to bring proceedings against you for breach of these Terms and Conditions, in your country of residence or any other appropriate country or jurisdiction.

• SHIPPING OF PRE-ORDERS IS COMMONLY BETWEEN 2- 14 WEEKS
• DELAYS CAN OCCUR RESULTING FROM CIRCUMSTANCES BEYOND OUR CONTROL
• ORDERS ARE CONSIDERED FINAL ONCE DEPOSIT IS RECEIVED
• PRE-ORDERS CANNOT BE CANCELLED, RETURNED OR REFUNDED EXCEPT FOR MAJOR FAULTS – STORE CREDIT WILL APPLY. 
• PAYING THE 50% DEPOSIT MAKES YOU BOUND BY THE TERMS AND CONDITIONS OF THIS PRE-ORDER SALE. 

The item on our website is not in stock which means it has reverted to a pre-order product.

• At the time of purchase you were aware the product was a pre-order, there was a wait on the product and you agreed to the terms set out on this Website.
• You have viewed the product online and accept the sizing, colour.
• You are aware of the total costs.
• The approximate lead times are between 2-14 weeks*
• Delivery & Assembly could be subject to additional costs depending on the product.

Delays & Delivery Times:

Luxo Styles will not be liable for any delays resulting from circumstances beyond our control or for any losses that are incurred as of any delays or force majeure of the purchaser.

As with all our products we endeavour to dispatch all deliveries as fast as possible to our customers, with many of our products being sourced internationally we may be affected by public holidays, inclement weather, port or custom delays all of which are beyond our control. All expected delivery times are estimates until the products are in our warehouse and ready for dispatch upon which time the standard delivery terms will apply.

All pre-orders are classified as a custom made goods as we would not have ordered them if you had not purchased them, as such some items are non-returnable. This does not exclude your rights under Australian Consumer Law (ACL) as you may still have warranties or guarantees on the product's description, fit for purpose and quality. For more information on this please refer to the Australian Consumer Law rights of a consumer.

All pre-orders are classified as custom orders and as such you will forfeit all or part of your money if you choose to cancel your order.

Pre-orders can take between 2 – 14 weeks to arrive in our ports and could be held for longer periods for Australian custom clearances, inclement weather, strikes and other issues that may arise which are out of our control.

Pre-orders can be carried out on our website or over the phone.

By paying part or all of the order, the customer agrees to accept the Terms and Conditions set out on this page and other relevant T&Cs pages.

The customer is aware that they are receiving a discount to accept part or all of the risk in the purchase.

Pre-orders cannot be cancelled without forfeiting their payment.

When the pre-order is accepted and ordered, the customer is liable to lose any monies paid.

1. We do everything we can to ensure that the prices on our and other companies websites are correct, and we try to keep our prices constant. Sometimes we need to change the cost of a product either up or down. 
2. Prices may be changed at any time without further notice. We reserve the right to change our product’s prices at any time without further notice. Prices listed in any other websites may not be accepted. We sell our products through a number of different online and offline channels and we cannot always control when they are updated. We reserve the right not to accept a price listed on a site other than our own. 

In no event shall Luxo Styles or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Luxo Styles Internet site, even if Luxo Styles or a Luxo Styles authorised representative has been notified orally or in writing of the possibility of such damage.
